Newsletter, Direct Marketing

According to Section 6 of Act XLVIII of 2008 on the Essential Conditions of and Certain Limitations to Business Advertising, the user may, in advance, expressly consent for the provider to send promotional offers and other direct mail to the user using the contacts the user indicated upon registration.
 
The user, taking the provisions of this information into consideration, may consent for the provider to manage the user’s personal data necessary for the sending of promotional offers.
 
The Service Provider shall not send unsolicited advertising messages, and User may unsubscribe from receiving offers without limitation and justification being given, and free of charge. In this case, Service Provider shall delete all the user’s personal data necessary to send advertising messages from its database, and shall not send further promotional offers to the User. User can unsubscribe from receiving advertising messages by clicking on the link in the message.
 
According to Section 20 Article (1) of Act CXII of 2011 on Informational Self-Determination and Freedom of Information, the following shall be determined related to data processing for sending newsletters:
 
a) the fact that data is being collected,
b) the data subjects targeted,
c) the purpose of data collection,
d) the duration of data processing,
e) the potential data controllers with the right of access,
f) description of the rights of data subjects.
The fact that data is being processed, the data processed: name, email address, date, time.
The data subjects targeted: every data subject who subscribed to the newsletter.
The purpose of data collection: sending electronic messages containing advertisements to the data subject, information on current news, products, promotions, new functions, etc.
The duration of data processing, deadline for the deletion of data: data processing is carried out until the consent is withdrawn, that is until unsubscribing.
The potential data controllers with the right of access: personal data can be processed by the employees of the data controller respecting the above principles.
Description of the rights of data subjects: The data subject can unsubscribe from the newsletter at any time.
Legal basis of data processing: the voluntary consent of the data subject, Section 5 Article (1) of Act CXII of 2011 on Informational Self-Determination and Freedom of Information, and Section 6, Article (5) of Act XLVIII of 2008 on the Essential Conditions of and Certain Limitations to Business Advertising.
The advertiser, the referencing service provider, and the publisher of the advertisement maintains a register on the personal data of persons making a statement of consent, related to the purpose of consent. The data–related to the recipient of the advertisement—registered in this registry shall only be processed according to the statement of consent until the withdrawal thereof, and shall only be transferred to a third party with the prior consent of the data subject.
